SECTION 1: PREAMBLE AND MANDATORY ACCEPTANCE OF TERMS

1.1. BINDING CONTRACTUAL AGREEMENT

PLEASE READ THIS DOCUMENT IN ITS ENTIRETY WITH EXTREME CARE.

This Charter constitutes a legally binding, irrevocable, and non-negotiable agreement between The Vote for Blayze Campaign (hereinafter referred to as "The Owner," "Licensor," "We," "Us," or "The Campaign") and YOU (hereinafter referred to as "The User," "Licensee," "Viewer," "The Infringer," or "Third Party"), being any individual, corporate entity, automated agent, spider, crawler, scraper, or organization that accesses, views, downloads, caches, stores, transmits, or interacts with any Digital Asset owned by The Campaign.

1.2. ACCEPTANCE BY CONDUCT

By performing any of the following actions, you unequivocally acknowledge, accept, and agree to be bound by the strict liabilities, penalties, and restrictions contained herein:

  • (a) Accessing the website kennysworld.net or any subdomain thereof;
  • (b) Viewing, liking, commenting, or sharing content on TikTok accounts @voteforblayze, @kennysworld.net, or @kennyssecretaccy;
  • (c) Adding, messaging, or viewing content on the Snapchat accounts associated with the campaign;
  • (d) Viewing any photograph, video, or graphic distributed by The Campaign on any platform;
  • (e) Downloading, copying, or possessing any source code, script, or file associated with The Campaign.
IF YOU DO NOT AGREE TO THESE TERMS, YOU ARE STRICTLY PROHIBITED FROM ACCESSING OUR CONTENT. YOU MUST IMMEDIATELY DISCONNECT AND PERMANENTLY DELETE ANY CAMPAIGN ASSETS IN YOUR POSSESSION.

SECTION 2: COMPREHENSIVE DEFINITIONS AND ASSET CLASSIFICATION

2.1. THE DIGITAL ASSETS ("THE WORKS")

The Campaign asserts absolute, exclusive, and unencumbered ownership over the following assets pursuant to the Copyright Act 1968 (Cth):

A. SOCIAL MEDIA CHANNELS:
Primary TikTok: @voteforblayze
Secondary TikTok: @kennysworld.net
Restricted TikTok: @kennyssecretaccy
Other Platforms: Any Instagram, X (Twitter), Facebook, Snapchat, or YouTube account operated by Blayze.

B. CINEMATOGRAPH FILMS:
Includes all published videos, deleted videos, private drafts, "Stories," live stream archives, screen recordings, raw footage (B-Roll), edited reels, and drone surveillance footage.

C. SNAPCHAT & EPHEMERAL CONTENT:
Includes all content transmitted via Snapchat handles (public or private), including "Snaps," "Stories," "Spotlights," "Chat Media," and audio notes. The ephemeral (disappearing) nature of this content does NOT waive copyright ownership or confidentiality status.

D. LITERARY WORKS (CODE & TEXT):
Source Code: HTML, CSS, JavaScript, PHP, Python, SQL, Ruby, Swift, and C++ code residing on kennysworld.net or private repositories (e.g., GitHub/GitLab).
Written Content: Manifestos, policy documents, speeches, blog posts, video captions, bio descriptions, comments, and email newsletters.

E. ARTISTIC WORKS:
All photography (digital and film), graphic designs, logos, banners, thumbnails, vector art, and UI/UX interface designs.

F. CONFIDENTIAL INFORMATION:
Direct Messages (DMs), Discord server logs, private emails, donor lists, voter databases, and internal strategy documents.

2.2. EXCLUSION OF THIRD-PARTY RIGHTS

NOTHING IS ABLE TO BE CLAIMED BY OTHERS.

For the avoidance of doubt, The Campaign rejects any and all claims of ownership by third parties.

  • Volunteers & Staff: Any work created by volunteers, contractors, or staff is deemed "Work Made for Hire" or assigned immediately to Blayze upon creation.
  • User Generated Content: Your interaction with our content (comments, duets, stitches) does not grant you any rights to the underlying original work.

SECTION 3: STRICT PROHIBITIONS AND USAGE RESTRICTIONS

3.1. TOTAL BAN ON UNAUTHORISED DISTRIBUTION

You are strictly prohibited from reproducing, distributing, displaying, selling, leasing, transmitting, creating derivative works from, translating, modifying, reverse-engineering, disassembling, decompiling, or otherwise exploiting the Digital Assets or any portion thereof.

3.2. THE "CLOUT CHASING" AND REPOSTING CLAUSE

You may NOT download, screen-record, rip, or capture video or audio from our accounts for the purpose of:

  • (a) Re-uploading to your own social media accounts (TikTok, YouTube Shorts, Instagram Reels);
  • (b) Reacting to the content for views or monetization;
  • (c) Creating compilations or "fan edits" without express written permission.

PENALTY: Any revenue generated by you from such unauthorized use shall be deemed to be held in trust for The Campaign, and we will seek an Account of Profits in the District Court of South Australia.

3.3. PROHIBITION ON AI TRAINING AND SYNTHETIC MEDIA

(a) Data Mining: You are prohibited from using spiders, bots, scrapers, or automated agents to harvest Campaign data for the training of Artificial Intelligence (AI) models, Large Language Models (LLMs), or Machine Learning datasets.

(b) Deepfakes: You are prohibited from using the voice, image, or likeness of Blayze to create "deepfakes," synthetic voice clones, or misleading media. Violation will result in immediate legal action for Defamation, Copyright Infringement, and Misleading or Deceptive Conduct under the Competition and Consumer Act 2010 (Cth).

3.4. PROPRIETARY CODE AND NO FORKING

All software and code associated with kennysworld.net is PROPRIETARY AND CLOSED SOURCE.

  • (a) You may not "fork," clone, or replicate our repositories.
  • (b) You may not inspect the source code via browser developer tools for the purpose of copying design elements.
  • (c) You may not attempt to bypass any authentication or security protocols.

3.5. THE "SNAPCHAT" & SCREENSHOT PROTOCOL

(a) Strict Prohibition on Capture: You are explicitly prohibited from using device features or third-party software to "Screenshot," "Screen Record," or otherwise capture ephemeral content sent by Blayze on Snapchat.

(b) Circumvention of Notification: Using modified apps (e.g., "Snapchat++", tweaked IPAs, or rooted/jailbroken devices) to save content without triggering the screenshot notification is a flagrant violation of the Copyright Act 1968 (Circumvention of Technological Protection Measures) and constitutes Digital Espionage.

(c) Evidence of Breach: You acknowledge that the "Screenshot Notification" received by The Campaign serves as admissible evidence of your breach of this Agreement.

SECTION 4: DEFAMATION, LIBEL & MALICIOUS FALSEHOOD

4.1. ZERO TOLERANCE FOR FALSEHOODS

The Campaign maintains a Zero Tolerance policy regarding the publication of false, misleading, or defamatory statements concerning Blayze Vercoe, campaign staff, or campaign policy.

4.2. PROHIBITED CONDUCT

You are strictly prohibited from publishing (on TikTok, Instagram, Snapchat, verbal conversation, or otherwise) any material that:

  • (a) Imputes dishonest, unethical, or illegal conduct to the Candidate;
  • (b) Is designed to lower the reputation of the Candidate in the eyes of reasonable members of the community;
  • (c) Constitutes "trolling" or cyberbullying;
  • (d) Utilizes fake screenshots or doctored evidence to fabricate scandals.

4.3. LEGAL CONSEQUENCES (DEFAMATION ACT 2005)

Pursuant to the Defamation Act 2005 (SA), The Campaign reserves the right to issue an immediate Concerns Notice to any individual (or their parents/guardians if under 18) found publishing defamatory material. We will seek:

  • (a) An immediate offer to make amends;
  • (b) A published apology and retraction;
  • (c) Damages for non-economic loss and reputational harm.

Satire or "it was a joke" is NOT a valid legal defence if the material is misleading or harmful.

SECTION 5: CONFIDENTIALITY AND TRADE SECRETS

5.1. "DO NOT DISTRIBUTE" CLASSIFICATION

Any document, file, video draft, or communication marked "CONFIDENTIAL," "DO NOT DISTRIBUTE," "INTERNAL USE ONLY," or "RESTRICTED" constitutes a Trade Secret of The Campaign.

5.2. EQUITABLE BREACH OF CONFIDENCE

Unauthorised possession, publication, leakage, or transmission of Restricted Material is a violation of the equitable doctrine of Breach of Confidence.

REMEDIES:

  • (a) Injunctive Relief: We will immediately petition the Supreme Court of South Australia for an interlocutory injunction to restrain further publication.
  • (b) Destruction Order: We will seek a court order requiring the forensic destruction of all devices hosting the stolen data.
  • (c) Damages: We will sue for full compensatory damages and legal costs.

5.3. SURVEILLANCE DEVICES ACT WARNING

Under the Surveillance Devices Act 2016 (SA), it is an offence to knowingly record a private conversation without the consent of all parties (subject to limited exceptions). Any attempt to secretly record Blayze or campaign staff will be referred to the South Australia Police (SAPOL).

SECTION 6: ENFORCEMENT PROTOCOLS AND TAKEDOWNS

6.1. ZERO TOLERANCE POLICY

The Campaign monitors the internet 24/7. We do not provide warnings. We do not provide "second chances." We take immediate, decisive, and aggressive action.

6.2. INTERNATIONAL ENFORCEMENT (DMCA)

For content hosted on US-based platforms (TikTok, YouTube, GitHub, X, Meta, Snapchat):

  • (a) We will file Digital Millennium Copyright Act (DMCA) Takedown Notices immediately.
  • (b) We will explicitly request that the service provider apply a Copyright Strike to your account.
  • (c) We will pursue a Permanent Ban for Repeat Infringement.

6.3. AUSTRALIAN ENFORCEMENT

For content hosted in Australia:

  • (a) We will issue Notices of Claimed Infringement to Carriage Service Providers under the Copyright Regulations 2017.
  • (b) We will refer unauthorised access of our systems to the Australian Cyber Security Centre (ACSC).

6.4. CRIMINAL LIABILITY

Unauthorised access to our website backend, private accounts, or databases is a criminal offence under:

  • (a) Part 10.7 of the Criminal Code Act 1995 (Cth) (Computer Offences); and
  • (b) Section 86G of the Criminal Law Consolidation Act 1935 (SA) (Unauthorised impairment of data).

WE WILL REPORT ALL HACKING, SCRAPING, OR UNAUTHORISED ACCESS TO POLICE.

SECTION 7: DAMAGES, INDEMNITY, AND MORAL RIGHTS

7.1. FLAGRANT INFRINGEMENT DAMAGES

You acknowledge that the unauthorized use of political campaign material causes unique and irreparable reputational harm. The Campaign reserves the right to seek Additional Damages under Section 115(4) of the Copyright Act 1968 (Cth) based on:

  • (a) The flagrancy of the infringement;
  • (b) The need for general deterrence; and
  • (c) The benefit shown to have accrued to the defendant.

7.2. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless Blayze, The Campaign, its agents, officers, and employees from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including but not limited to solicitor-client legal fees) arising from: (a) Your violation of any term of this Charter; (b) Your violation of any third-party right, including without limitation any copyright, property, or privacy right.

7.3. ASSERTION OF MORAL RIGHTS

Pursuant to Part IX of the Copyright Act 1968 (Cth), Blayze asserts his Moral Right of Integrity of Authorship. You must not subject the works to derogatory treatment (distortion, mutilation, or material alteration) that is prejudicial to the author's honour or reputation.

SECTION 8: GOVERNING LAW AND SEVERABILITY

8.1. JURISDICTION

This Agreement shall be governed by and construed in accordance with the laws of the State of South Australia and the Commonwealth of Australia.

  • (a) You submit to the exclusive jurisdiction of the Magistrates Court of South Australia, the District Court of South Australia, and the Supreme Court of South Australia.
  • (b) You waive any objection to venue or forum non conveniens.

8.2. SEVERABILITY

If any provision of this Charter is found to be invalid or unenforceable by a court of competent jurisdiction, such invalidity shall not affect the enforceability of the remaining provisions, which shall remain in full force and effect.

BY ACCESSING, VIEWING, OR POSSESSING ANY CONTENT FROM @VOTEFORBLAYZE, @KENNYSWORLD.NET, @KENNYSSECRETACCY, OR SNAPCHAT, YOU AFFIRM THAT YOU HAVE READ, UNDERSTOOD, AND AGREED TO THESE STRICT TERMS WITHOUT RESERVATION.
